1. Scope of application
These General Terms and Conditions apply to all services in the field of Recruitment provided by batthub GmbH, based in Bern. Any deviating terms and conditions of the client shall only apply if they have been agreed in writing.
2. Scope of services
The specific scope of services is defined individually in the respective offer or contract. batthub GmbH does not act as an employer or personnel agency, but as an external recruiting partner. The final selection decision and appointment lies exclusively with the client.
3. Cooperation and obligations to cooperate
The client undertakes to provide all information, access, and documents necessary for the execution of the services in a timely manner. Regular communication to coordinate priorities, feedback, and process issues is part of the cooperation.
4. Remuneration and terms of payment
Remuneration is based on the agreed hourly rate, daily rate, or flat rate. Invoices are due for payment within 1030days net. All prices are exclusive of statutory value-added tax.
5. Confidentiality and data protection
Both parties undertake to maintain confidentiality regarding all information arising from the collaboration that is not publicly known. Personal data will be processed in accordance with the Swiss Data Protection Act (DSG). Where necessary and under certain conditions, the GDPR shall also apply.
6. Liability
batthub GmbH shall only be liable for damages caused by gross negligence or intent. Liability for the selection, suitability, or conduct of the proposed candidates is excluded.
7. Term and termination
Services already rendered up to the date of termination will be invoiced on a pro rata basis.
8. Applicable law and place of jurisdiction
Swiss law applies exclusively. The place of jurisdiction is Bern, unless there is a mandatory legal place of jurisdiction.
