General Terms and Conditions
1. scope of application
These GTC apply to all services in the area of Recruitment Process Outsourcing (RPO) and Interim Recruiting provided by batthub GmbH, based in Bern. Deviating terms and conditions of the client shall only apply if they have been agreed in writing.
2. scope of services
The specific scope of services is defined individually in the respective offer or contract. batthub GmbH does not act as an employer or recruitment agency, but as an external recruiting partner. The final selection and employment decision lies exclusively with the client.
3. cooperation and obligations to cooperate
The client undertakes to provide all information, access and documents required for implementation in good time, and a regular exchange to coordinate priorities, feedback and process issues is part of the cooperation.
4. remuneration and terms of payment
Payment shall be made in accordance with the agreed hourly rate, daily rate or flat rate and invoices shall be due for payment within 10 days net. All prices are exclusive of statutory value added tax.
5 Confidentiality and data protection
Both parties undertake to maintain confidentiality regarding all non-public information arising from the collaboration, and personal data will be processed in accordance with the Swiss Data Protection Act (DPA). If necessary and under certain conditions, the GDPR also applies.
6. liability
batthub GmbH is only liable for damages caused by gross negligence or intent. Liability for the selection, suitability or conduct of the proposed candidates is excluded.
7 Term and termination
Services already rendered up to the termination date will be invoiced on a pro rata basis.
8 Applicable law and place of jurisdiction
Swiss law shall apply exclusively. The place of jurisdiction is Bern, unless a mandatory legal place of jurisdiction exists.
